Dear Feroze Brailsford
I am writing in response to your Official Information Act 1982 (the Act) request of 22 July
2019. Specifically you requested:
“I request all information held my New Zealand Police in relation to Operation Faga.”
I have considered your request and my response is as follows.
Please see attached the Operation Order that was produced for Operation FAGA. Sections
within this document are withheld pursuant to pursuant to section 6(a) and 6(c) and 9(2)(a)
of the Act. All other information that falls within the scope of your request is declined
pursuant to the above sections.
Section 6(a) provides good reason to withhold official information where the release of that
information is likely to “prejudice the security or defence of New Zealand or the international
relations of the government of New Zealand”.
Section 6(c) provides good reason to withhold official information where the release of that
information would likely “prejudice the maintenance of the law, including the prevention,
investigation, and detection of offences, and the right to a fair trial”.
Sections 9(2)(a) provides good reason to withhold official information in order to protect the
privacy of staff involved in the policing of the operation.
If you are not satisfied with my response to your request, you have a right under section
28(3) of the Official Information Act 1982 to ask the Office of the Ombudsman to seek an
investigation and review of my decision.
