Our consideration of your request
We refer to the Official Information Act request you submitted to the Department of
Conservation on 12 September 2019.
Owing to the nature and tone of your email, we consider that there are grounds to
believe that the request you have made is vexatious.
In saying that we also note that information previously provided to you by DOC
under the Official Information Act 1982 (including images and scientific data
concerning the use of 1080 and other toxins) has subsequently been edited and
republished. This has been conducted in a manner that misrepresents the scientific
evidence and facts around the use of 1080 in predator control programmes in New
Zealand.
Given the factors cited above, we have decided to refuse your request under section
18(h) of the Act.
You are entitled to seek an investigation and review of my decision by writing to an
Ombudsman as provided by section 28(3) of the Official Information Act.
