Your Official Information Act request, reference: GOV-002331
Thank you for your request of 24 October 2019, asking for the following information under the Official
Information Act 1982 (the Act):
•
The current Schedule of Delegation (or documents providing jurisdiction or similar but not limited
to) for review by Fairway Resolution and Independant Complaints Review Authority (ICRA).
How ACC reviews are legislated
The functions of review hearings, and the dispute resolution process, are covered in Part 5 of the
Accident Compensation Act 2001 (the AC Act). We contract Fairway and ICRA to supply reviewer
services to ACC. Because this is a service provided to our clients, and we have contracted this service to
external providers under the AC Act, there is no need for any approval or delegation to do so on behalf
of the Minister or the ACC Board.
You can find Part 5 of the AC Act via the link below:
http://www.legislation.govt.nz/act/public/2001/0049/latest/DLM101816.html
There is no schedule of delegation, or other documents providing jurisdiction or similar, that relate to
the review functions of Fairway or ICRA. Your request is therefore declined under section 18(e) of the
Act, on the grounds that the information you have asked for does not exist.
