Official Information Act 1982 (OIA) – Response – OIA 2019/269
Thank you for your information request, which was received by Capital & Coast District Health Board
(CCDHB) on 17 December 2019. You requested the following information:
“… all the emails/files/memorandum relating to the sale process of 29
Everton Terrace. This would include the any information from 2009 and
2018/2019.”
Please find our response to your request below.
Response The sales process of 29 Everton Terrace is incomplete, and still requires a number of approvals.
Therefore CCDHB must decline your request for information under section 9(2)(j) of the OIA, as the
withholding of this information is necessary to enable CCDHB to carry on, without prejudice or
disadvantage, negotiations (including commercial negotiations).
We note that, on 8 January 2020, you agreed to suspend your request for information on the condition
that you received ‘the signed contract’ the following Monday. As the sales process for 29 Everton
Terrace was not near completion by this time, it would not have been possible for CCDHB to provide you
with the signed contract the following Monday. We therefore sincerely apologise for the delay in
responding to your information request, and acknowledge that this request should not have been
suspended.
You have the right, under section 28 of the OIA, to seek an investigation and review by the Ombudsman
