REQUEST FOR OFFICIAL INFORMATION – RELEASE OF INFORMATION
Thank you for your request for official information dated 19 March 2020.You have requested the
following from Queenstown Lakes district Council (QLDC).
Please provide a full copy of the lease granted in March 2018 by QLDC to QAC, including all
schedules, appendices or attachments forming part of the lease.
QLDC response
The signed memorandum of lease dated 8 March 2018 (
Lease) did not include the Third, Fourth and
Fifth Schedules because these items were not formally confirmed between the parties at the time of
signing (as contemplated by the side letters exchanged between QLDC and QAC on 8 March 2018).
The status of the schedules is as follows:
Third Schedule – Land Plan: The QAC side letter records (at para 3.1) that, once confirmed
between the parties, a head lease plan which was previously prepared is intended to be
converted into the “Land Plan” and (and subject to confirmation of the Project Pure access
routes) the “Project Pure Plan”(more below) – i.e. formal survey plans intended to be used
for title registration purposes.
Fourth Schedule – Project Pure Plan: As per para 3.2 of the QAC side letter, the Project Pure
Plan is intended to be a formal survey plan (a) identifying the Project Pure land area (being
areas excluded from the Lease), and (b) identifying the access routes over such parts of the
leased Land Area necessary for QLDC to continue to access the Project Pure site.

The formal survey of the plans to be annexed to the third and fourth Schedules is yet
to be completed, but the head lease plan can be provided. Please see the below link

Fifth Schedule – Baseline Contamination Report: The QAC side letter records (at para 3.4)
that QLDC and QAC will, upon approval of the PSI report and/or intrusive site investigation
(each party acting reasonably), annex the report to the Fifth Schedule of the lease, please
