Dear Mr Carrol
Transfer of your request for information to the New Zealand Police
Thank you for your request of 30 March 2020 under the Official Information Act 1982 (the
Act) to the Ministry of Health (the Ministry) for:
“…I would like to ask if it is lawful for a medical student to test passing motorists at a
checkpoint in this way and if it is under what legislation or New Zealand law is this
permitted? If it was not lawful what action is being taken by the Ministry of Health
against this medical student?”
The Ministry does not hold information pertaining to your request. However, I have been
advised that this information is more aligned with the functions of the New Zealand Police.
As a result, I have decided to transfer your request to the Police under section 14 of the Act.
You can expect a response from the Police in due course.
You have the right, under section 28 of the Act, to ask the Ombudsman to review any
decisions made under this request.
Yours sincerely
Zoe Royden
Manager (Acting) OIA Services
Office of the Director-General
