Thank you for your email of 8 May 2020 to the Ministry of Business, Innovation & Employment (the
Ministry), requesting the following under the Official Information Act 1982 (the Act):
I would like to know how to access to past employer stand down list, as the website only have
current updated one available. If it’s not public available, may I request you to send me all the
previous stand down list you have on file.
Also, I remembered seeing one of the list contains “ WHAT'S JIANBING LIMITED (5762867)
Registered”, can you please confirm if my memory is correct and what is the reason for it’s
inclusion. Have you conduct any future follow up with this company to ensure it’s ongoing
compliance?
The Ministry has attached ten files of previous stand down lists that had been published on the
Employment NZ website. Our records date back to June 2017.
In regards to What’s Jianbing Limited (5762867); the company received an Infringement Notice for a
breach of section 64 (1) of the Employment Relations Act 2000 (ERA). They received a fine for the single
breach which they paid and were placed on the Employment New Zealand stand down list for six
months. No follow up action has been undertaken to check for ongoing compliance after they had
served their time on the stand down list.
You have the right to seek an investigation and review by the Ombudsman of my decision to withhold
information relating to this request, in accordance with section 28(3) of the Act. The relevant details can
