[FYI request #13147 email] Dear Ms Simpson
Thank you for your email of 25 June 2020, asking what prison Mark Lundy is
currently held in. Your request has been considered under the Official
Information Act 1982 (OIA).
Corrections is statutorily obliged to protect all private information that we hold,
including information relating to people in prison. We are unable to release the
information you have requested as doing so would contravene our obligations
under the OIA and Privacy Act 1993. Therefore, your request is refused in
accordance with section 9(2)(a) of the OIA, to protect the privacy of natural
persons.
As per section 9(1) of the OIA, we have also considered whether there are
countervailing public interest considerations favouring the release of the
requested information. We do not believe such considerations are present in
this case.
For your information, Corrections’ policy regarding the sending and receiving of
mail by prisoners is outlined in the Prison Operations Manual, available at:
https://www.corrections.govt.nz/resources/policy_and_legislation/Prison-
Operations-Manual/Communication/C-01-Prisoner-mail You can send mail to a person in prison to the Department of Corrections
National Office, clearly stating who the mail is for. Your letter will be forwarded
to them if they are in custody. It is up to the person in prison to decide what they
choose to do with the letter and whether they will respond or not.
Should you have any concerns with this response, I would encourage you to
raise them with Corrections. Alternatively, you are advised of your right to also
raise any concerns with the Office of the Ombudsman. Contact details are:
Office of the Ombudsman, PO Box 10152, Wellington 6143.
