Thank you for your email of 3 July 2020 to Oranga Tamariki—Ministry for Children
(Oranga Tamariki), requesting the following information under the Official Information
Act 1982 (the Act):
•
Please provide copies of al Memorandum of Understanding (MOU’s) signed in the
last five years related to the sharing of data to organisations outside your
organisation.
On 13 July 2020, we contacted you to clarify the type of information sharing agreement
you were seeking. You responded on 14 July 2020, advising that we limit the request to
the following type of agreement.
•
Information Sharing Agreements that relate to the specific exchange of information
between parties, general y used for research purposes.
Please find enclosed with this response copies of the following Memorandums of
Understanding (MOUs) and Approved Information Sharing Agreements (AISAs), signed
between 1 July 2015 and 1 July 2020:
• AISA between the New Zealand Gang Intel igence Centre Agencies, 7
November 2018
• AISA between the Ministry of Education, Oranga Tamariki and the Ministry
of Social Development (MSD), to support services for disengaged youth,
May 2020
• MOU for Youth Justice National Minimum Dataset, 30 October 2015
• MOU between the Ministry of Education and Oranga Tamariki, 10
December 2018
• MOU between Stats NZ and Oranga Tamariki, 18 April 2019
• MOU between Ministry of Social Development and Oranga Tamariki, 1 July
2019
You wil note that the contact details of some individuals within these documents have
been withheld under section 9(2)(a) of the Act, in order to protect the privacy of natural
persons.
Oranga Tamariki was established as a new ministry on 1 April 2017 and was formed
from Child, Youth and Family, the Children’s Action Plan, Community Investment and
certain functions of MSD. You wil note that Oranga Tamariki was not an original
signatory for the Youth Justice National Minimum Dataset MOU (YJ MOU) in 2015.
Following our establishment, however, the functions covered by the YJ MOU were
transferred over from MSD to Oranga Tamariki. As per section 30H(3) of the State Sector
Act 1988, due to the relevant functions being transferred over, the references to MSD
within the YJ MOU must now be read as references to Oranga Tamariki, which is the new
responsible departmental agency.
From 1 July 2019, new provisions came into effect in regard to section 66 of the Oranga
Tamariki Act 1989. These changes give child welfare and protection agencies the ability
to request, col ect, use and share personal information for purposes related to the
wel being and safety of tamariki. Additional information on these new provisions can be

as a link to an AISA for Improving Public Services for Vulnerable Children that was
signed in June 2015.
