Thank you for your requests of 17 and 18 November 2020 to Kāinga Ora – Homes and
Communities requesting information under the Official Information Act 1982 (the Act). I
have addressed your questions individually below.
a copy of any settlement agreement in relation to Tenancy Tribunal case 4270276
Can we have a copy of any agreement or settlement with the tenant in relation to

Copies of any settlement agreement with our tenant, or correspondence related to a
settlement, is their personal information, as well as being subject to legal privilege.
Therefore, I am withholding this information under the following sections of the Act:
9(2)(a)
the withholding of the information is necessary to protect the privacy of
natural persons, including that of deceased natural persons
9(2)(h)
the withholding of the information is necessary to maintain legal
professional privilege.

Correspondence between Kāinga Ora and Meredith Connell regarding the Tenancy
Tribunal case and issues related to methamphetamine is subject to legal privilege and is
withheld under section 9(2)(h) of the Act. I am also withholding copies of invoices under
the following section of the Act:
9(2)(b)(ii)
the withholding of the information is necessary to protect information where
the making available of the information would likely unreasonably to
prejudice the commercial position of the person who supplied or who is the
subject of the information.
Can we have all internal correspondence, emails, reports and meeting minutes in
relation to the adoption of the Gluckman Report? Can we have all correspondence,
reports, emails, meeting minutes between the executive team, including Greg
Groufsky & Andrew McKenzie, and the Board of HNZ know known as Kainga Ora
about the Gluckman Report Can we have all correspondence, meeting minutes,
reports, both internally and externally, about the Gluckman Report being peer-
reviewed
Information that Kāinga Ora holds on the former Housing New Zealand’s response to
methamphetamine contamination in its properties, which includes any information held
about the Gluckman report, is publicly available on the Kāinga Ora website at
https://kaingaora.govt.nz/publications/methamphetamine-contamination-response/.
Therefore, I am refusing this part of your request under the following section of the Act:
18(d)
that the information requested is or will soon be publicly available.
In Adjudicator Prowse order dated 11 September 2020 of TT case 4270276. Can we
have the information specified in paragraphs 3, 4 and 5.
Our tenant’s file, as referenced in paragraph 3 of the Tenancy Tribunal Order, is our
tenant’s personal information and is being withheld under section 9(2)(a) of the Act.
The documents referenced in paragraphs 4 and 5 are as follows:
P-250 Policy for managing methamphetamine (meth) in Kāinga Ora-managed
properties
report from the New Zealand Police.
These are attached in Appendices A and B, respectively.
I do not consider that the public interest in release of the information withheld in response
to your requests outweigh the need to withhold it. You have the right to seek an
