Tēnā koe John Smith
I refer to your two emails of 9 and 10 April 2021, in which you request the following under the
Official Information Act 1982 (OIA):
I would like to request the results of the constitutional referendum held in Niue on 13
June 1992.
I would like to know does the Niue Amendment Act 2007 (Public Act 2007 No 71) applies
to Niue? Are sections 170 and 171 of the Niue Act 1966 still in force in Niue?
We have reviewed the archive material held in relation to the first point of your request and
have located one document that contains the results of the 1992 Niue referendum. This
document is attached for your reference.
In relation to your second point, this request is refused under section 18(g) of the OIA as it is
not seeking official information held by the Ministry, but rather seeking an opinion from the
Ministry on the application of legislation in Niue. If you are seeking information about
legislative provisions in Niue, you may wish to contact the Government of Niue directly.
Contact information for the relevant government departments is available online at:
https://www.gov.nu/wb/pages/central-agencies.php The Niue Act 1966, and the two repealed sections referred to in your request, are also
available online at:
https://www.legislation.govt.nz/act/public/1966/0038/latest/whole.html You have the right under section 28(3) of the OIA to seek a review of this response by the
Ombudsman.
