Thank you for your email of 2 May 2021, asking for the following information under the Official
Information Act 1982 (the Act):
Could you please send me copies of all ACC board minutes for the period Jan 2019 - April 2021.
Decision on your request
Under the Act, we are required to make a decision on whether or not to grant a request for official
information within the time limits set out in section 15(1). Section 15A(1) also applies in cases where an
extension of time has been applied. In compliance with those sections, we can advise you that we are
granting your request.
We are withholding some information from the board minutes under the fol owing grounds:
• 6(a) – prejudice to the security or defence of New Zealand or the international relations of the
Government of New Zealand
• 6(d) – likely to endanger the safety of any person
• 9(2)(a) - protect the privacy of natural persons
• 9(2)(b)(ii) - prejudice to commercial position
• 9(2)(f)(iv) - constitutional conventions which protect the confidentiality of advice
• 9(2)(g)(i) – to maintain the effective conduct of public affairs through the free and frank
expression of opinions
• 9(2)(g)(ii) – to protect officers and employees from improper pressure or harassment
• 9(2)(h) - legal privilege
• 9(2)(i) - to carry out, without prejudice or disadvantage, commercial activities
• 9(2)(j) - to carry on, without prejudice or disadvantage, negotiations
• 9(2)(k) – to prevent the disclosure or use of official information for improper gain or improper
advantage.
Provision of the requested board minutes
At this stage, we are stil preparing the documents for release, which wil include a final review by key
ACC staff and board members. We wil provide you with the documents once this has been completed.
We expect to be able to provide you with 12 board minutes early next week, and the balance at a later
date.
