Response to your request for official information Thank you for your request under the Official Information Act 1982 (the Act) to the Ministry of
Health (the Ministry) on 17 May 2021. Specifically, you requested:
“ As I now am informed, that The Nuremburg Code has no legal standing in New Zealand,
by you, The Ministry of Health, by way of a previous information request, I now request a
copy of any and all correspondences you may hold that reference The Nuremberg Code.
This to include information that determines any decisions made with regard to the
adoption or otherwise of the said Code"
On 19 May 2021, the Ministry wrote to you seeking to narrow the scope of your request. We
noted that in its current form, your request for “any and all correspondences” that reference the
Nuremburg Code would likely be refused under section 18(f) of the Act on the grounds that it
would require substantial collation or research. Given the Code was issued in 1947 and you
have given no time frame, the Ministry would have to search through a large number of email
accounts for current and former employees to ascertain whether there are any references to the
Code as well as undertaking a substantive search through its physical and electronic archives.
We also outlined a narrower and more manageable scope to your request and asked you to
agree to this revised scope.
As of today’s date, the Ministry has yet to receive a response seeking to narrow the scope of
your request. Therefore, it is refused under section 18(f) of the Act on the grounds that it would
require substantial collation or research.
Under section 28(3) of the Act you have the right to ask the Ombudsman to review any
