Re: Avondale Macrocarpa
Thank you for your request for information, which we received on 02 June 2021 about the
Macrocarpa on land on the corner of Great North Road and Ash Street in Avondale,
Auckland.
The details of your request and our response is below.
“Specifically, I seek information on:
1) all representations the Mayor or his staff received from Mana Rākau, Steve Abel,
Gael Badlock, Mary McMullin, Margaret Stanley or others concerned to protect the
Macrocarpa, including proposals allowing the Macrocarpa to remain on the site;
2) all representations the Mayor or his staff received from other parties in support of
the Macrocarpa being removed from the site; and
3) all communications the Mayor or his staff had with Mana Whenua on this matter,
including what views Mana Whenua expressed to the Mayor or his staff, and how
these were considered.”

A number of documents that were captured in our search have not been included in the
bundle as they were out of scope or duplicates. These account for many of the gaps in the
numbered documents.
Additionally, the below documents have been fully withheld:
• A letter referenced in the attachment
number 8 has been withheld under section
7(2)(g) - legal professional privilege and;
• An email correspondence between Mark Todd and Dr Claudia Wyss, dated 3rd and
5th February 2021 has also been withheld under section 7(2)(b)(ii) of the LGOIMA, as
the making available of this information would be likely unreasonably prejudice the
commercial position of a third party.
However, in summary, the email informed the council of an agreement reached by Ockham
with a third party to enable the development to proceed. Ockham also offered to fund the
addition of some trees in the Whāu area to the Notable Tree Schedule. In response, Dr Wyss
explained the steps open to the parties that would not require such funding.
