Dear Mr Collins,
I refer to your Official Information Act 1982 (OIA) request dated 10 June 2021 in
which you requested the following:
The statistics / total number of "Inconsistent and fabricated sexual
complaints" were made under the Adult sexual assault investigation", per
year (2010 to 2020), per gender, complaint category.
You specifically asked:
1. how many "Inconsistent and fabricated sexual complaints" were
made?
2. How many charges progressed to prosecution?
3. How many charges were dismissed?
4. How many were convicted.
5. How many complaints were recorded as K3 "no offence disclosed"
6. How many were arrested "K9" ?
7. How many were cautioned "K4"?
8. How many not arrested, not cautioned but proceeded by some other
means "K6".
Questions 3 and 4 of your request have been transferred to the Ministry of
Justice (MOJ) under the provisions of section 14 of the OIA, as information
relevant to that request is held by the MOJ.
Police publishes statistics based on what is prescribed in legislation, including
statistics on proceedings against of enders for
‘False Statement That Offences
Committed’ offences. However, these statistics do not distinguish whether the
proceedings relate to “sexual assault” or any other specific offences.
Police is therefore unable to provide the data requested in respect of ‘Sexual
Assault’ and “Fabricated complaints”. Your request is refused under section 18(f)
of the OIA as the information cannot be made available without substantial
collation or research.
If you are not satisfied with my response to your request, you have the right
pursuant to section 28(3) of the OIA to complain to the Ombudsman and seek a
review of the Police’s decision.
