Dear Mr Brown,
I am writing to you in response to your email sent to New Zealand Police on 9
August 2021, which was made pursuant to the Official Information Act 1982 (OIA)
and specifically requested:
The privacy impact assessment (or equivalent document, policy) for the
NZ Police's use of video footage from the
https://www.communitycam.co.nz/index.cfm
Community Cam has been developed independent of Police. The Community
Cam website holds a register of household owners who have a CCTV camera on
their property only. Any footage uploaded is encrypted to maintain security.
Should NZ Police contact any of the registered owners on the site, they must
provide a warrant or case number to provide assurance to the homeowner that
the request for any footage is in relation to evidential requirements.
The site is now going through a thorough due diligence process to ensure that all
security, privacy, legal and ethical factors are being reviewed and considered.
A privacy impact assessment for the New Zealand Police use of video footage for
Community Cam has not been prepared to date.
Therefore, your request is refused under s 18(e) of the OIA in that the information
you have requested does not exist.
You have the right, under s 28 (3) of the OIA to ask the Ombudsman to review
my decision if you are not satisfied with the way I have responded to your
request.
