Thank you for your Official Information Act (Act) request received by the Department of Internal
Affairs (Department) on 29 November 2021.
You requested –
We would like to request for the following details Full name:__________ Full
Address____________, for Frank from The Handymen Cannn Nationwide NEW ZEALAND
This letter is to advise I must refuse your request pursuant to section 9(2)(a) of the Act. This is
because the withholding of any information the Department may or may not hold is necessary
to protect the privacy of a natural person.
The reason for withholding the information under section 9(2)(a) must be weighed against other
considerations that render it desirable, in the public interest, to release the information. I have
identified a public interest in release of the information - to enable you to lodge a claim in the
Disputes Tribunal. However, I consider that this interest does not outweigh the interest in
withholding the information. I note that you have other avenues available, like reporting the
trader to Police. Police may be able to access the information from the Department, or from the
Ministry of Business, Innovation and Employment.
I also note that the information you have provided would likely not be sufficient for the
Department to identify the person at issue, as the Department holds information on individuals
in their personal capacity and does not hold information about related businesses. The name
“Frank” would likely return hundreds of thousands of records.
You have the right to seek an investigation and review by the Ombudsman of this decision.
