Thank you for your Official Information Act (the Act) request of 8 December 2021.
You have asked for:
1. Al the correspondence received by the Department or Library relating to the
proposals regarding the Internet Archive from individuals or organisations outside
government.
2. A copy of the legal opinion cited in the
Stuff article from Andrew Brown QC and
barrister Jack Oliver-Hood.
In response to part one of your request, the correspondence has been provided to you as a
PDF file entitled
Documents for OIA release – Ecclestone. Some material in the file has been
withheld under the fol owing sections of the Act, unless the person has asked that the
section not be applied:
• s9(2)(a) to protect the privacy of natural persons.
In response to part two of your request, a copy of the legal opinion has not been provided to
either the Department of Internal Affairs or the National Library of New Zealand, therefore I
am declining your request under section 18(g) of the Act as the information is not held.
You have the right to seek an investigation and review by the Ombudsman of this decision.

You may be aware that the National Library is reconsidering its plans for the Overseas
Published Col ections (OPC) in light of concerns raised by the various interested parties,
including issues associated with copyright. The National Library will not export any of the
OPC until it has considered its options for the next steps.
