Thank you for your Official Information Act 1982 (OIA) request of 19 January 2022 seeking
the following information from the New Zealand Security Intelligence Service (NZSIS):
I would like to request copies of the following documents on the topic of the 2021 reissue of the
CusMod Direct Access Agreement:
1) All briefings prepared for the NZSIS Responsible Minister
2) All briefings prepared for the Minister of Customs
including any briefings which accompanied the DAA when it was presented to these ministers for
their approval.
On 14 February 2022 you were notified of a partial transfer of part two of your request
(
briefings prepared for the Minister of Customs) to the New Zealand Customs Service, under
section 14 of the OIA.
Decision on your request
NZSIS holds information that falls within scope of your request. That information has been
assessed for release to you, subject to the following provisions of the OIA:
s6(a), where the making available of the information would be likely to prejudice the
security or defence of New Zealand or the international relations of the Government
of New Zealand;
s9(2)(a), withholding of the information is necessary to protect the privacy of natural
persons; and
s18(d), the information requested is publicly available.
In October 2021 the NZSIS and New Zealand Customs Service sent a Joint Briefing Note to
Ministers Little and Whaitiri regarding the re-issue of the CusMod Direct Access Agreement.
Please find attached a copy of this document, including Appendixes 1 and 2.
Appendix 3 of the document was a copy of the Direct Access Agreement and Privacy Impact
Assessment. These are available on our website:

methods/working-with-other-organisations/ and as such, your request for this information is
refused under section 18(d) of the OIA. A classified version of the Privacy Impact Assessment
was also included in Appendix 3 – this document is withheld in full under s6(a) of the OIA.
