I refer to your request for information dated 11 April 2022, which was received by Greater
Wellington Regional Council (Greater Wellington) on 11 April 2022. You have requested the
following:
“
Further to my recent request for information about the Environment Court proceedings. I note
that the document GWRC has provided entitled: "Affirmation of lain Nicholas Dawe in support of
section 293 application 1 October 2021 refers to:
•
GWRC contacting all territorial authorities about the matter and also receiving confirmation
from those parties (para.36)
•
GWRC filing a memorandum dated 23 April 2021 with the Environment Court.(para.37)
Please provide me with:
1. in respect of Para. 36 of Mr Dawe's affirmation all correspondence to and from Porirua City
Council
2. in respect of Para. 37 of Mr Dawe's affirmation a copy of the 23 April 2021 memorandum
and a list of recipients.”
Greater Wellington’s response follows:
1. Correspondence with Porirua City Council
Greater Wellington contacted Porirua City Council and spoke with planning staff in February 2021 to
discuss the s293 application prior to submission and invited feedback. This was followed up with
written email correspondence between 1 and 22 March 2021. This correspondence can be viewed
in
Attachment 1.

Porirua City Council was contacted again on 5 October when Counsel acting on behalf of Greater
Wellington, applied to the Environment Court for a declaration and consequential orders in relation
to the way river mouths are identified in the Proposed Natural Resources Plan. This correspondence
can be viewed in
Attachment 2.
2. 23 April 2021 memorandum and recipients
Attachment 3 is a copy of; “Memorandum of counsel on behalf of Wellington Regional Council:
Updating Court as to consent order process dated, 23 April 2021”, that was referenced in;
“Affirmation of lain Nicholas Dawe in support of section 293 application dated, 1 October 2021. We
have withheld some information in
Attachment 3 under section 7(2)(a) of the Local Government
Official Information and Meetings Act 1987 – to protect the privacy of natural persons, including that
of deceased natural persons.
We have considered whether the public interest in the requested information outweighs Greater
Wellington’s need to withhold certain aspects of the requested information. As a result, we do not
consider that the public interest outweighs Greater Wellington’s reason for withholding parts of the
document under the ground identified above.
The 23 April 2021 Memorandum was issued before the Environment Court at Wellington I Mua I te
Kōti Taiao Te Whanganui-a-Tara Rohe.
If you have any concerns with the decision(s) referred to in this letter, you have the right to request
an investigation and review by the Ombudsman under section 27(3) of the Local Government Official
Information and Meetings Act 1987.
