Thank you for your email regarding your request for the documents under the Official Information
Act 1982.
I refer to your request under the Official Information Act 1982 (OIA) dated 6 April 2022. The details
of your request are set out below:
Please supply the following information under the [Official Information Act (OIA) / Local
Government Official Information and Meetings Act (LGOIMA)]:
For East Cape deep water wharf or Barging:
o
Any correspondence regarding Shovel ready project P269 known originally as " Hicks
Bay deep water wharf " and the change in project use and scope to "Marine
infrastructure"
o
Approval by cabinet including dates, to change project from “Hicks Bay Deep water
wharf” to “Marine Infrastructure” and or "Barging"
o
Approval by IRG ministers including dates, to change project from “Hicks Bay Deep
water wharf” to “Marine Infrastructure" and or "Barging".
As you will be aware, community consultation is underway on this project, and as such ministers
are yet to make a final decision on whether to provide funding through the COVID-19 Response
and Recovery Fund (CRRF).
As such, I am refusing your request under section 9(2)(f)(iv) of the OIA, which protects information
relating to matters still under active consideration.
It is noted that in relation to the information withheld, you are entitled to make a complaint to the
Office of the Ombudsmen under section 28(3) of the OIA to seek a review of the decisions to
withhold such information.
