Clamping signage located on Victoria Street
Thank you for your request made under the Local Government Official Information and Meetings
Act 1987 (the Act), received on 14 May 2022. You requested the fol owing information:
• Is the Council aware of anyone being clamped in this location?
• Has the Wel ington City Council authorised the clamping of vehicles in this location, being
land that has been vested to the Council for road?
• Has the Wel ington City Council granted exclusive possession of this piece of road to anyone,
and if so, what are the terms of that agreement?
• Has the Wellington City Council authorised the $500 release clamp release fee, through the
exception to the $100 limit, described at section 98D of the Land Transport Act 1998?
• If the answer to question 4 is ‘no’, what wil the Wel ington City Council do in response to
this unlawful activity on land that they are responsible for?
I have been in touch with the Councils Transport and Infrastructure team regarding this matter and
I can confirm the works undertaken here on Victoria Street has been approved by the Council by
way of an approved Traffic Management Plan (TMP) and Road User License (RUL).
On investigation, the clamping signage mentioned in your correspondence was not part of the
approved TMP or RUL. In response to your correspondence a Council Officer was on site on 18 May
2022 and discussions were held with the site supervisor who apologised profusely for using these
signs and any inconvenience caused.
I understand these signs, of which there were two, have been removed. I can confirm that no
vehicles were clamped. The site supervisor has been reminded of what correct signage can be used,
as per their approved TMP/RUL, and to work with the Councils Parking Services team if they are
experiencing members of the public using the parking spaces that align with the approved TMP and
RUL.
