Request for information under the Official Information Act 1982
Thank you for your email on 20 July 2022 to the New Zealand Customs Service (Customs),
requesting the following information under the Official Information Act 1982 (the Act):
"I would like to make a request for copies of all Privacy Impact Assessments
produced for Joint Border Analytics team initiatives since the beginning of 2020".
In response, attached are five Privacy Impact Assessments produced for Joint Border
Analytics team initiatives since 2020:
• Overarching Privacy Impact Assessment for single agency analytics
• Shore Parties
• Sea Freight
• Counter Terrorism
• Extreme Right Wing.
Some information in these documents has been withheld in accordance with the following
grounds under the Act:
• section 6(c) of the Act, where the release of information would be likely to prejudice
the maintenance of the law, including the prevention, investigation, and detection of
offences, and the right to a fair trial
• section 9(2)(g)(i) of the Act, where withholding information is necessary to maintain
the effective conduct of public affairs through the free and frank expression of
opinions
• section 9(2)(g)(ii) of the Act, where withholding information is necessary to maintain
the effective conduct of public affairs through the protection of Customs staff from
improper pressure or harassment
• section 9(2)(h) of the Act, where withholding information is necessary to maintain
legal professional privilege.
Customs has considered the public interest arguments in favour of making this information
available, however, it is considered that these interests do not outweigh the necessity to
withhold the information.
You have the right, by way of complaint to the Office of the Ombudsman under section 28(3)
of the Act, to seek an investigation and review of the decision conveyed in this letter.
