I refer to your Official Information Act request of 9 August 2022 for the fol owing:
Could I please have all advice the Ministry has provided to the Minister relating to a
National Maori Entity, in the last 12 months?
…If the new entity identifies an area where it believes the system is not giving effect to
the principles of Te Tiriti, wil it have an advisory role or wil the Entity have the power
to force other operators within the system to change decisions or plans? Does the
Ministry have any internal documents analyzing such questions? Could these please be
released to me?
What is the form of input the entity wil have into the National Planning Framework?
What is the process where the Minister and the Entity disagree? Do you have any
internal documents assessing this question? Can these be released?
What is the status of advice the Entity provides to "anyone working in the system"?
Wil this advice be binding, alternatively, wil other parts of the system simply have to
respond to this advice, or can they ignore it if they wish? Do you have internal
documents assessing these questions? Can these be released?
I am writing to notify you that the Ministry for the Environment is extending the timeframe
for its response to your request under section 15A(1)(b) of the Act, as consultations necessary
to make a decision on the request are such that a proper response cannot reasonably be
made within the original timeframe.
We wil now respond to your request on, if not before, 20 September 2022, which is an
extension of 10 working days.
You have the right to seek an investigation and review by the Ombudsman of my decision on
this request, in accordance with section 28(3) of the Act. The relevant details can be found at:
www.ombudsman.parliament.nz.
