Dear OIA Auckland Request
Thank you for your email of 23 September 2022 to Kāinga Ora - Homes and Communities,
requesting the fol owing information under the Of icial Information Act, 1982 (the Act):
Kindly supply ful details of all contracts awarded to the following firms over the past 5
years
1) Johnstaff Projects (NZ) Ltd
2) Stellar Projects Ltd
3) RCP Limited
Please include
- Contracts awarded through RFP process
- Contracts awarded directly awarded.
- Value and sum of each of the above contracts
- Any sub-contractors working under these contracts
On 12 October and 13 October 2022, we requested a proof of your eligibility to make a request
for official information in accordance with section 12 of the Act.
On 14 October 2022, you responded back by suggesting we should consider the above request
under the Local Government Official Information and Meetings Act 1987 (LGOIMA). We advised
you that LGOIMA does not apply to Crown agencies such as Kāinga. LGOIMA applies to local
government agencies such as:
1. city, district and regional councils;
2. council-control ed organisations;
3. local and community boards;
4. licensing trusts; and
5. airport authorities
As we not satisfied of your eligibility to make the above information request under section 12 of
the Act, we are refusing to respond to your request, based on the eligibility criteria set by the Act
and the Ombudsman’s guidance on it. If you wish to reinstate your request in the future, we ask
that you provide sufficient proof of eligibility.
You have the right to seek an investigation and review by the Ombudsman of this response.
