Dear John,
Your Official Information Act 1982 request reference OIA 2223-0437
Thank you for your email of 30 November 2022 requesting the following under the Official
Information Act 1982 (the Act):
“
I noted, https://gazette.govt.nz/notice/id/2022-g...
May I ask what is the reason for this Revocation of Appointment. When you would call
for public nomination for this vacant position to the public?”
Under section 74(6) of the Films, Videos, and Publications Classification Act 1993 (the 1993
Act) the Minister of Internal Affairs (the Minister) is required to review, at intervals of not
more than three years, the community representative appointments to the Film and Video
Labelling Board. Section 74(1) determines there must be at least one person carrying out the
community representative role.
Earlier this year the Minister reviewed the positions and determined that, because of the
ongoing decline in demand for the board’s services, the number of community
representatives could be reduced from three to two. The revocation notice followed on from
this decision. Community representative positions are advertised when appointments are
made. Should the Minister need to make further appointments the positions would be
advertised on Te Tari Taiwhenua | the Department of Internal Affair’s website and other
online job websites.
You have the right, under section 28(3) of the Act, to seek an investigation and review of my
decision by the Office of the Ombudsman. The postal address of the Office of the
Ombudsman is PO Box 10152, Wellington. Alternatively, you can phone 0800 802 602 or
email [email address].
We intend to publish our response to your request on www.dia.govt.nz. This letter, with
your personal details removed, will be published in its entirety. Publishing responses
increases the availability of information to the public and is consistent with the Act’s
purpose of enabling more effective participation in the making and administration of laws
and policies and promoting the accountability of Ministers and officials.
Nāku noa, nā
