I refer to your Official Information Act 1982 (OIA) request dated 5 March 2023 in which
you requested:
I want to know police s.o.p on any discretion regarding a disqualified driver ie: a
disq driver is pulled over in a deregistered vehicle, is the officer required to
impound the vehicle and charge the driver, or can they let them go without penalty
at their own discretion?
An enforcement officer is required to impound the vehicle for 28 days. Section 96(1) of the
Land Transport Act 1998 states:
An enforcement officer must seize and impound, or seize and authorise the
impoundment of, a motor vehicle for 28 days if the officer believes on reasonable
grounds that a person drove the vehicle on a road while—
(a) the person was disqualified.
