Official Information Act request: Tenancy orders
Thank you for your email of 28 April 2023, requesting under the Of icial Information Act 1982 (the
Act), information about the Tenancy Tribunal (the Tribunal). Specifically, you requested:
“… every Tenancy Tribunal order held by your agency. This should include both PDF
copies of the orders, as well as metadata containing information regarding the parties, the
tenancy address, etc. As a guiding principle, the information I request should be provided
in a format similar to the online search form at https://forms.justice.govt.nz/search/TT.”
While the Act binds the executive (Ministers and government agencies), court and tribunals are
specifically excluded from its ambit under section 2(6)(a) and (b). This recognises that courts and
tribunals are a separate and independent arm of government with their own rules for access to
information. Any orders the Ministry of Justice (the Ministry) holds, it does so as an agent of the
Tribunal. Therefore, your request is refused under section 18(g) of the Act on the grounds that the
information requested is not held by the Ministry or any other agency subject to the Act.
