Official Information Act request: Wrongful convictions
Thank you for your email of 16 May 2023, in which you requested information regarding
wrongfully convicted people:
‘A list of all cases sent to court which have originally been convicted at guilty then later
found as wrongfully found guilty since January 2003. Please also state the officer in
charge of each investigation’
On 14 June and 21 June 2023, the Ministry sought to clarify your request with you, advising
you that your request would be closed if a response was not received from you by 23 June.
A response from you was not received.
The Ministry of Justice (the Ministry) does not hold the information that has been requested.
This information may be held on the court file; however, courts are excluded from the
operation of the Act under section 2(6)(a). I am therefore refusing your request under section
18(g)(i) of the Act as the information is not held by the Ministry, or any other agency subject
to the Act. The courts would be best placed to help you with this, and we suggest
approaching them for help to access your requested information.
