Thank you for your request made under the Local Government Official Information and Meetings
Act 1987 (the Act), received on 19 May 2023. You requested the fol owing information:
1. The register of waterfront hazards.
2. Reports on health and safety at the waterfront commissioned by Wellington City Council
and Wellington Waterfront Limited (originally Lambton Harbour Management Limited).
3. Accident reports about people who have been drowned, killed or injured as a result of falls
from heights greater than 1.0m at the waterfront.
4. Documents about council and subsidiary organisation(s) employees' responsibility as
'Person Conducting a Business or Undertaking' (PCBU) for safety from fal ing under the
Health and Safety at Work Act 2015.
5. Communications with WorkSafe New Zealand about safety from falling at the waterfront
6. Any other safety improvements recommended to prevent fal s from heights greater than
1.0m at the waterfront.
Wellington City Council has partly
granted your request for information. Our decision on each
request has been provided below:
1. Your request for the Waterfront hazards register is part of our health and safety register.
This will take us some time to prepare the information for release, we hope to get this to
you by 26 June 2023. Please note under section 7(2)(a) of the Act some information has
been withheld to protect the privacy of individuals. Our records only go as far back as 2015,
anything prior to 2015 has been refused under section 17(e) of the Act that the document
al eged to contain the information requested does not exist or despite reasonable efforts to
locate it can not be found.
2. Request for health and safety reports on the Waterfront has been provided, please see
attached. The oldest record that we could find regarding Waterfront safety report was from
2005, anything prior to 2005 has been refused under section 17(e) of the Act, that the
document al eged to contain the information requested does not exist or despite reasonable
efforts to locate it can not be found.
3. The Council does not have accident reports, we have events registered into our health &
safety register which wil be provided to you soon. Your request for accident reports has
been refused under section 17(e) of the Act, that the document al eged to contain the
information requested does not exist or despite reasonable efforts to locate it cannot be
found.
4. There is no specific document related to “safety from falling”. The Council does have a “Our
Statement of Commitment 2021” which outlines our staff responsibilities regarding Health
& Safety for staff and other people. This encompasses all health and safety matters.
5. The Council does not hold communication with Worksafe regarding fal ing on the
Waterfront. This part of your request has been refused under section 17(e) of the Act as the
document to contain the information requested does not exist.
6. There are no other safety recommendations provided other than what has been listed in our
reports.
