Thank you for your email of 23 June 2023, to Mahi Haumaru Aotearoa | WorkSafe New Zealand,
requesting the following information:

I am a NZ citizen seeking information on incidents on the waterfront that have been
reported and/or notified to Worksafe by Wellington City Council, or its subsidiaries in the
year 2021 in respect of the Wellington Waterfront.
This should include all incidents where Worksafe have been notified of people falling into
voids or gaps in the areas and wharves around the waterfront. Of particular interest is
around or on the Taranaki Street Wharf.

This should include:
1. Date and time of the incident
2. Date and time it was reported
3. Action taken by Worksafe in respect of the incident
4. Any reports provided to Worksafe in respect of the incident
5. Any reports produced by worksafe in respect of the incident
Your request has been considered under the Official Information Act 1982 (OIA).
WorkSafe receives notifications for many things, such as notifications regarding incident, illness,
injury or fatality, and notifications of concern or complaint about a health and safety matter. All of
the notifications are considered for whether they are in fact a
notifiable event. A notifiable event is
an unplanned or uncontrol ed incident in relation to a workplace that exposes the health and safety
of workers or others to a serious risk arising from immediate or imminent exposure. The
Wellington waterfront is considered a public space. While Wellington City Council maintains the
area, it is not a workplace unless a specific area is marked off for work. Therefore, incidents of
individuals falling into the water when no work is being undertaken is not considered a notifiable
event.
I can advise that WorkSafe undertook a search of our information systems, and no notifications
from Wellington City Council, its subsidiaries or any other notifications of an individual falling into
voids or gaps in the areas and wharves around the waterfront were able to be located. The only
file that was located that had any similarity to the information you have sought, was not a
notification of an incident, but a concern about the safety of the waterfront, in general. A summary
of that concern is below.

Notification type: Health and Safety Concern
Details: Wel ington waterfront around Queens Wharf and other areas is considered a
working waterfront area, therefore a workplace. There have been a number of deaths

down there over recent years, including a drowning that occurred there on 10 July 2021.
Outcome: Concern referred to Wellington City Council, as not WorkSafe purview. File
closed.
