Dear K
Official Information Act Request
Our Ref: OIA353/1
On 6 August 2023 you sent an email request to the Ministry of Justice seeking information
under the Official Information Act 1982 (the Act) about judicial entitlements including
monetary and non-monetary payments and benefits.
Your request was transferred to the Crown Law Office for a response. The information
you have requested is held by the Crown Law Office in the Solicitor-General’s function of
supporting the Attorney-General as senior law officer. The ombudsmen have noted that
the office of Attorney-General falls outside the scope of the Act (Ombudsman’s Quarterly
Review (1999) Vol 5, issue 2, p4, and Case No W41067, 12th Compendium of Case Notes
of the Ombudsman). As such, information about judicial entitlements is not official
information that is subject to the Act.
You can find publicly available information about judges’ remuneration and
superannuation in the following determinations of the Remuneration Authority (at
www.legislation.govt.nz):
•
Judicial Officer Salaries and Allowances (2022/2023) Determination 2022
•
Judicial Officer Superannuation Determination 2019
In accordance with s 19 of the Act, I advise you have a right, by way of complaint under s
28(3) of the Act, to seek an investigation and review of this decision by way of complaint
to the Ombudsman. Information about how to make a complaint is available at
www.ombudsman.parliament.nz or freephone 0800 802602.
Yours faithfully
Crown Law
