I refer to your request for information dated 30 March 2023 regarding the cellular/ internet network
infrastructure on streetlights rol out.
I wil answer your questions in the order you have asked them.
This is to request under the Local Government Official Information and Meetings Act 1987 copies
of all publicly available information (i.e published information that does not require a LGOIMA to
access) regarding the cel ular/ internet network infrastructure on streetlights rol out across
Auckland.
To our knowledge there is no rol out programme of work. Telco’s are entitled under Section 136 of
the Telecommunications Act 2001 to instal cel ular towers in the road reserve and equipment on
Auckland Transport (AT) streetlight poles [subject to reasonable conditions imposed by AT, typical y
locations of cabinets, and are subject to the code known as the National Environmental Standards
for Telecommunication Facilities 2016 (NESTF)], Note

by its
nature is publicly available and potentially accessible via Google searches or similar, depending
upon the information sought. To our knowledge, AT has no information in the area of
“the cellular/
internet network infrastructure on streetlights rol out”
because as far as we are concerned there is
no ‘rol out’ taking place which AT is a party to.
This is to also request copies of any procurement, tender or partnership documentation relating to
this development, and copies of any regulatory impact statements (or similar), recommendations
or reports generated that relate to the rol out of cel ular/ internet network infrastructure on street
lights/ AT control ed property across Auckland.
There is no procurement or tender documentation available as AT is not a party to any “rol out or
development”
by Telco’s who make their own decisions in these areas. AT does have written
agreements with Telco’s covering fees for administering the advice from Telco’s as to where they
wish to establish new sites (or improve existing equipment). AT have not generated any such
reports as Telco’s have rights granted to them by legislation and we can only ask them to reposition
or move from their preferred spot (more or less) for road safety reasons.

Your request for tender, procurement documentation, regulatory impact statements and reports is
therefore declined under Section 17 (e) of the LGOIMA as the information does not exist.
Should you believe that we have not responded appropriately to your request, you are able to make
a complaint to the Office of the Ombudsman in accordance with section 27(3) of the LGOIMA and
seek an investigation and review in regard to this matter.
