Dear S.I
Request for information
Thank you for your Official Information Act 1982 (OIA) request dated 22 August 2023.
You asked:
Please provide a breakdown for the last 5 years of financial redress /
compensation / negotiated settlement payments made by NZ Police fol owing
police conduct such as negligence, malfeasance, abuse of power on official
duties such as, but not limited to, undertaking search warrants, arrest warrants,
warrantless searches & arrests, interacting with the public, and problematic
prosecutions, for example - failing to prosecute, malicious prosecution, issues
with disclosure, vexatious prosecution and so forth.
This would include civil cases where BORA breaches have been litigated.
A brief description of why a payment was made, and the amount paid would be
great if possible.”
Police Legal Services are the budget holder for civil litigation and compensation claims
made against Police and the information that we hold with regards to your request is set
out in the table below.

As many of the settlement payments that are made by Police are subject to confidentiality
clauses, we are  unable to provide specific  details  of individual claims.  However, the
cases listed in the table  above  include, claims for damages, compensation,  privacy
breaches, legal costs awards, and BORA breaches.
From time to time the various Police districts will make compensation payments, out of
their own separate budgets, for issues such as minor damage to property or belongings.

Police Legal Services are not routinely notified of these payments, so this table doesn’t
capture everything that may have been paid.
Historic compensation claims against Police, should they arise, would also be paid out
of the Police Legal Services budget.
I trust this information is of use to you.
Yours sincerely
