Response to your request for official information
Thank you for your request under the Official Information Act 1982 (the Act) to Manatū Hauora
(the Ministry of Health) on 27 August 2023 further information regarding our agency’s
compliance with legislation, as a follow up to information previously provided to you on this topic
(H2023028765 and H2023030056 refers). You requested:
Can I please have copies of all of the reports that are stored electronically (and are thus
easily retrievable). A subset such as the 10 years of reports up to the current reporting
period is acceptable in the event that it is not possible for some technical reason to
provide the rest.
The requested legislative compliance survey reports from 1 July 2013 – 30 June 2021 are
attached to this letter as Appendix 1 and have been released to you in full. The 2022/ 23 report
is currently being drafted and is not yet finalised or available for release. The 1 July 2021- 30
June 2022 report has been excluded, as this was provided to you in a previous response
(H2023020056 refers). Please note, these reports were produced annually from the 2014/15
report, and twice-yearly prior.
Can I please also have confirmation of the reporting years in which each piece of
legislation that the Ministry administers has been surveyed (to cover the entire period of
reporting unless unachievable for some technical reason).
I am assuming that the Ministry does in fact survey them all. If this is not the case I please
have the details of each piece of Ministry administered legislation not addressed in
legislative compliance reporting.
The reports set out the legislation included in them. A list of overall legislation administered by
Manatū Hauora is publicly available here:
www.health.govt.nz/about-ministry/legislation-and-
regulation/legislation-ministry-administers.
I note that emails to [email address] are generating auto replies from
[email address]. Why was this email address not supplied as part of the response to
H2023031009 which requested, amongst other things, contact details for submitting
complaints?
As you have identified, the
[email address] email address is referred to the
[email address] site, which is the generic email address for queries to Manatū Hauora.
That supports the triage process but as previously explained, any complaints that are received
are triaged by referral through to the relevant part of Manatū Hauora for review, investigation as
appropriate and response.
If you wish to discuss any aspect of your request with us, including this decision, please feel
free to contact the OIA Services Team on: [email address].
Under section 28(3) of the Act, you have the right to ask the Ombudsman to review any
decisions made under this request. The Ombudsman may be contacted by email at:
[email address] or by calling 0800 802 602.
Please note that this response, with your personal details removed, may be published on the
Manatū Hauora website at:
www.health.govt.nz/about-ministry/information-releases/responses-
official-information-act-requests. Nāku noa, nā
