Thank you for your email of 7 July 2023, to the Ministry of Justice (the Ministry), requesting
under the Of icial Information Act 1982 (the Act), information about the publication of
Covid-19 judgements by the courts. Specifically, you requested:
1. Please would you supply all the criteria for publishing a "Covid 19 related judgement"
on this page of court decisions page:
https://www.courtsofnz.govt.nz/judgments/covid-19-related-judgments/
2. Would you kindly share the reasons why the following cases which took place in the
public court in 2021 and 2022 which are Covid-19 related are not available on the NZ
Courts decisions finder? -Canaday v Medical council of NZ CIV-2021-085-000781 -
Whittome v Taupo Tennis and Ors CIV-2022 -069-000021, -Reihana v Air NZ CIV-
2022-404-000436 [2022] NZHC 2425

Kindly share the memos, minutes and decisions which came about for the above
publishing criteria of "Covid-19 related Judgements".
The Courts website communications guidelines says decisions about the publication of
judgments and associated documents are court information. Because Court information is
not subject to the Act under section 2(6)(a), I am refusing your request under section 18(g)(i)
of the Act, because the Ministry does not hold the information and I have no grounds for
believing it is held by another agency subject to the Act.
