I refer to your email dated 2 February 2024 in response to our decision to decline your official
information request (question 21j as set out below) dated 7 November 2023 referring to the
Council Public Agenda (20230927) and Attachments
"The [5 August 2020 Attachment to the Report] report item 4.15 refers to a support in writing by
Ngāti Hāua Iwi Trust, please provide a copy of this."
We advised you 2 February that Ngāti Hāua Iwi Trust had been consulted on this matter and
considered the letter of support to be out of scope of this LGOIMA request as it is unrelated to the
Teitei Drive development.
The Trust objected to the release of the Letter of Support in accordance with sections 7(2)(b),
7(2)(c), 7(2)(i), 7(2)(j), and 17(h) of the Local Government Official Information and Meetings
Act 1987. Council carefully considered the Trust's views at the time and decided to withhold the
information at issue. Council's position has not changed.
You have the right to seek an investigation and review by the Ombudsman of
this decision.
