Thank you for your email of 24 November 2023 to the Ministry of Business, Innovation and Employment
requesting, under the Official Information Act 1982 (the Act), the following information:
Please provide how Immigration New Zealand determines whether a company is ongoing during the process
of assessing Accreditation applications, and what is the process for assessing a company's sustainability?
What evidence is needed to demonstrate a company's sustainability? Please provide the Immigration internal
assessment templates and training materials.
On 21 December 2023, MBIE sent you a decision letter noting that we had made a decision to grant part of
your request, but that it would take us some time to process.
We also noted that that Standard Operating Procedures, assessment templates and training materials within
scope of your request will be withheld under section 6(c) of the Act, as making available that information
would be likely to prejudice the maintenance of the law, including the prevention, investigation, and detection
of offences, and the right to a fair trial.
Our Response
Immigration New Zealand (INZ) assesses an employer accreditation application against immigration instruction
WA2.10. This instruction details the requirements in terms of a business being viable and ongoing. There is a
wide range of ways that assessment may be completed.
The instruction gives a range of the evidence types as examples that may be provided in support of the
requirements being met. The instruction is not prescriptive and allows the employer to provide evidence as
they see fit in satisfaction.

While INZ holds Standard Operating Procedures, assessment templates and training materials on this topic, as
