Official Information Act request relating to the number of retail locations in Northland 
under the Smokefree Amendment Act. 
 
Thank you for your request made under the Official Information Act (the Act), received on 29 
November 2023. You requested: 
 
“I refer you to the Prime Minister's press conference today (29th November 2023) on 
the 100 day Plan. Mr Luxon repeatedly said that under the Smokefree Environments 
and Regulated Products (Smoked Tobacco) Amendment Act, there would be a single 
retailer of tobacco products in Northland. 
 
Please supply the following information under the Official Information Act (OIA): 
 
Any information you have about the number of retail locations in Northland. In 
particular, any documents that would prove or disprove the Prime Ministers claim. 
 
If you need any more information from me please let me know as soon as possible.” 
 
I believe that the information you have requested is more closely connected with the functions 
of the Ministry of Health. Accordingly, I have decided to transfer your request to the Ministry of 
Health under section 14(b)(ii) of the Act. 
 
The Ministry of Health has the usual timeframes under the Act from receipt of this transfer to 
make a decision on your request.
