Thank you for your email of 8 December 2023 to the Ministry of Business, Innovation and Employment
(MBIE) requesting, under the Official Information Act 1982 (the Act), the fol owing information:
Can I please request all information that MBIE has provided to new or former
Ministers in November and December 2023 in regard to Mt Ruapehu Ski Fields,
the liquidation of RAL.
The fol owing document is in scope of your request:
•
Briefing for the Incoming Minister for Regional Development – November 2023
Please note that the information relating to Ruapehu Alpine Lifts Limited (RAL) is very minimal,
however we believe this is still relevant to your request. This document is due to be proactively
released to the MBIE document library in the next few weeks, and no later than the end of February
2024. MBIE is therefore refusing your request under section 18(d) of the Act, as the information
requested is or will soon be publicly available. Please note some information, relating to RAL,
contained within this document has been withheld to protect confidential advice to the government.
During the post-election period (which ran from 15 October 2023 until the new government was
sworn in) the caretaker convention applied until the new government was appointed. During this time,
the RAL related information that was provided to the former Minister pertained to Ministerial Services
work only.
Please note that we have deemed this administrative material as being out of scope of your request.
This material consists of emails relating to Official Information Act requests and entries in three
fortnightly reports to the Minister, where MBIE provided a list of active Official Information Act
requests (some of which relate to RAL). These emails or entries do not contain any new information,
advice or updates to the Minister relating to the ongoing situation with RAL, but are provided to keep
the Minister aware of what requests MBIE is working on, or provide support for Ministerial Servicing
functions.
We have not provided these as we do not believe these are in scope of your request.
If you wish to discuss any aspect of your request or this response, or if you require any further
assistance, please contact
[email address].
You have the right to seek an investigation and review by the Ombudsman of this decision.
