[FYI request #2510 email]
Dear Lee M
Official Information Act Request
I refer to your email request of 19 February 2015, asking for information about Rex
Woodhouse under the Official Information Act 1982 (the Act).
ACC initially responded to this request on 4 March 2015, seeking proof of your
standing to make Act requests, as required by section 12 of the Act. You failed to
respond directly to this request, but ACC subsequently received the required proof
via another channel and has responded to your other
www.FYI.org.nz requests.
Unfortunately, ACC inadvertently overlooked providing a final response to this
request and apologises for the delay.
Response
ACC has considered your request and has determined that it is not a request for
official information under the Act.
The Act requires ACC to make decisions on releasing information it holds. It does not
require ACC to respond to requests for its opinion, or to comment on the validity of
the previously released information, or to an individual’s point of view, such as set out
in your request.
As you correctly stated in your email, factual information about Mr Woodhouse has
been previously released by ACC. There is no new information that we can provide
on this matter. Consequently, ACC wil not respond to your questions under the Act.
If you are unhappy with ACC’s response to your request you have the right to make a
complaint to the Office of the Ombudsman. You can call them on 0800 802 602, 9am
to 5pm weekdays, or write to:
The Office of the Ombudsman
