Tēnā koe Nicholas,
Official Information Act request
Thank you for your request under the Official Information Act 1982 (OIA), which we
received on 18 December 2023.
You said:
Could you send me a list of al media that’s been banned for containing
“homosexual themes”, “lesbian themes, “queer themes” or other lgbtq
related reasons.
Could you break this down into two lists one showing those that are banned
for just lgbtq related stuff and one that’s also banned for other things (such
as exploitation of a minor)
Please provide as ether a table or csv. Please include any extra
informations (date of publication, date of classification, author, who
reviewed it etc) as reasonable
In responding to your request, we have weighed up the factors in the OIA,
including the purposes i
n section 4 and the principle of availability in
section 5.
Response to your request
Te Mana Whakaatu—Classification Office does not hold a list of the kind you
describe. Accordingly, your request is refused unde
r section 18(e) of the OIA.
Additional information
No publications have been banned solely because of LGBTQ+ content or themes
under our current legislation, the Films, Videos, and Publications Classification Act
1993. Historically, some publications that deal with LGBTQ+ content and themes
were banned by the Indecent Publications Tribunal under previous legislation.
1
Some of those publications remain illegal in Aotearoa New Zealand.
1 The Tribunal was a predecessor to the Classification Office. It existed from 1964 to 1994.
Attached is a list of some written or printed publications with LGBTQ+ content or
themes which have been classified by the Tribunal. Banned publications are in
red.
Te Mana Whakaatu—Classification Office compiled this list so that we can
systematically review these classifications as part of our work with Rainbow
stakeholders in our historical publications project. Part of this work involves
determining whether these publications should remain banned for other reasons.
We expect to conclude this work in 2024.
This list refers only to written or printed material and does not include films, games,
or other types of publications which are banned and contain LGBTQ+ content or
themes.
Publication of response
This response may be published on the Classification Office’
s website. If it is
published there, your personal information will be redacted.
Right of review
You have the right to make a complaint and seek a review by the Ombudsman of
this response under
section 28(3) of the OIA. Information about this process is
available at
ombudsman.parliament.nz or freephone 0800 802 602.
Thank you for your interest in our mahi.
Ngā mihi nui,
Te Mana Whakaatu—Classification Office
