Thank you for your email of 11 January 2024 to the Ministry of Business, Innovation and Employment
(MBIE) requesting, under the Official Information Act 1982 (the Act), the following information:
On September 6, 2023 Josh Hercus emailed John Marney (TSY) including cashflow and
additional analysis for the Cabinet paper Ruapehu Alpine Lifts - options for government
support.
This request is for those documents.
I am also requesting all correspondence between Josh Hercus and other parties covering
updates on RAL, post watershed which include the term PTL or Pure Turoa.
On 25 January 2024 you narrowed your scope to:

This request is for those documents.
I am also requesting all correspondence between Josh Hercus and either:
(a) the Office of the Min of Regional Development covering updates on RAL, post
watershed through to 1 September 2023 which include the term PTL or Pure Turoa or
(b) Pure Turoa (PTL) from the watershed meeting through to 1 September 2023.
You requested the fol owing two attachments, which were included in an email sent by Josh Hercus on 9

These documents are being withheld in ful under the fol owing sections of the Act:
• 9(2)(b)(ii), to protect information where the making available of the information would be likely
unreasonably to prejudice the commercial position of the person who supplied or who is the
subject of the information;
• 9(2)(j), to enable a Minister of the Crown or any public service agency or organisation holding the
information to carry on, without prejudice or disadvantage, negotiations (including commercial
and industrial negotiations).
I do not consider that the withholding of this information is outweighed by public interest considerations
in making the information available.
You requested al correspondence between Josh Hercus and Pure Tūroa (PTL), from the watershed
meeting (20 June 2023) through to 1 September 2023. MBIE is refusing this part of your request under
section 18(e) of the Act, as the document al eged to contain the information requested does not exist or,
despite reasonable efforts to locate it, cannot be found.
You requested al correspondence between Josh Hercus and the Office of the Minister of Regional
Development, covering updates on RAL, post watershed meeting (20 June 2023) through to 1 September
2023, which include the term PTL or Pure Tūroa. MBIE wil provide a response but needs to extend the
time available to make a decision on this part of your request. MBIE’s response wil be sent to you no
later than 6 March 2024.
The reason for the extension is that consultations with various third parties necessary to make a decision
on your request are such that a proper response cannot reasonably be made within the original time
limit.
