Purpose
1. This briefing sets out the consultation process for Ministerial appointments to Tertiary
Education Institutions (TEIs) in 2024.

2. Who you consult with varies depending on the category of entity.

Workforce Development Councils
7. The process for appointing to WDCs is set out in secondary legislation – Orders in Council
(OiC). There are six OiCs, one for each of the WDCs. The OiCs have basically the same
structure, but there are variations in the details.
8. Only the Services WDC - Ringa Hora and the People, Food and Fibre WDC - Muka Tangata
have ministerial appointees. Both WDCs are required to draw nominations from across the
industries they cover. They must appoint panels independent of the Council to consider those
nominations, and then to make recommendations to you (and the Minister of Agriculture for
Muka Tangata). You can only veto the names put forward and ask for further
recommendations.
9. As with Te Pūkenga, we are currently engaging with you on your intentions for WDCs and we
wil advise you on WDC appointments as needed in due course.

Consideration stage
14. TEC wil provide you with advice on all appointments. We will work with your Office on the
timing and form of the advice we provide for all appointments. Our timetable is informed by
Cabinet and Appointments and Honours Commit ee (APH) meeting dates.

16. In practice, it is usually your advisors who sound out preferred names with parliamentary
colleagues and/or contact the relevant local Member of Parliament in confidence. Names being
considered must be kept confidential to minimise the risk of lobbying by, or on behalf of,
candidates. Sometimes this consultation results in new names, which are referred to the TEC
for due diligence before you consider them.
Cabinet and APH stage
17. Once you have decided on your preferred candidates, the convention is that you share your
intentions with Cabinet colleagues – usually via the Appointments and Honours Committee
(APH). After Cabinet has received the APH minute, the Minister normally shares the names
with colleagues at the next Caucus meeting.
18. The TEC prepares for your signature the letters of appointment, letters of thanks for outgoing
council members, and letters to inform the Chair or Chancellor about the appointment. Once
you sign these, the person is a council member. Your office will email the letter when it is
available, and your office would normally provide a media release for the Beehive website.
