Thank you for your information request dated 19 February 2024, regarding the Producer 
Statement Authorship (PSA) structural engineering reviewer. 
 
In response to your request, I consulted with the council’s Building Consents department to 
provide relevant information. The specific details of your request and our response is below. 
 
(1) the original agreement/terms of reference between Auckland Council and the 
external contractor 
 
There was no formal contractual agreement between Auckland Council and the external 
consultant.  
 
We have consulted with the consultant about this arrangement who has confirmed that 
no formal agreement was put in place. This arrangement was initiated by a request from 
Auckland Council in 2017 and a verbal conversation took place with the consultant and a 
manager who is no longer employed by Auckland Council.  
 
Therefore, we are unable to provide you with this information under section 17(e) of the 
Local Government Official Information and Meetings Act 1987 (LGOIMA) as the 
information requested does not exist or, despite reasonable efforts to locate it, cannot be 
found. 
 
(2) how long the agreement was intended to go on for when it started in 2017 
 
The original request in the email pertains to coverage of a holiday period of 3 months, 
however, the consultant has confirmed that on the return of the staf  members, they 
continued to be requested on an as-needed basis.   
 
(3) assessment/decision documents on the engagement continuing beyond the 
period originally envisaged 
 
The consultant has emailed to confirm that once the period of leave cover was over, 
requests were continued on an as needed basis.  
As there are no assessment/decision documents, we are unable to provide you with this 
information under section 17(e) of the LGOIMA.

(4) current agreements/instructions to the contractor 
 
It is on a casual basis, so no terms have been agreed. 
 
Please refer to the at ached relevant confirmation email from the consultant for your 
reference.

because withholding of this information is necessary to maintain the effective conduct of 
public affairs through the protection of employees.
