Thank you for your request for official information dated 17 March 2024. You requested the following
information from Queenstown Lakes District Council (QLDC / Council):
• Can you advise what advice you have received regarding ticketing cars at the Frankton marina
and what legal ability you have to do so given the land is reserve land.
• Could you also provide a copy of the lease or licence granted to Veolia and a copy of the public
advertising seeking to grant that lease for their continued occupation of that land.
• If there is no lease/licence, could you advise whether you will be taking legal action against
yourself for this breach and what immediate steps, you will be taking to remedy this situation.
• Could you also advise why you are disregarding the reserves act and whether you have staff who
understands the act

QLDC Response
Please see our response below:
•
Can you advise what advice you have received regarding ticketing cars at the Frankton marina
and what legal ability you have to do so given the land is reserve land.
The Reserve area is Local Purpose (Marina) Reserve, and the area has a posted restriction and is
enforced. Council as the Administering Body of the Local Purpose Marina Reserve has delegation
to set parking requirements, restrictions and conditions. This restriction has been in place for
many years. Please see the attached Council resolution regarding “
PARKING AT FRANKTON
MARINA RECREATION RESERVE” that answers this part of your request.

Could you also provide a copy of the lease or licence granted to Veolia and a copy of the public
advertising seeking to grant that lease for their continued occupation of that land.
Veolia are contracted by Council as the Administering Body of the Local Purpose Marina Reserve,
to undertake critical infrastructure works from that Reserve and in the Frankton Track reserve.
Council has not put a lease/licence in place for its own contractor to undertake its works within
the reserve and the reserve purpose can still be fulfilled.

If there is no lease/licence, could you advise whether you will be taking legal action against
yourself for this breach and what immediate steps, you will be taking to remedy this situation.

We are not disregarding the Act, and Councils actions are as the Administering Body. There is no
posted prohibition on public accessing the reserve, and they can still do so for trailer and vehicle
parking. However, for health and safety reasons, the area associated with the infrastructure works
is temporarily fenced.
