Dear Mr Coyle
Thank you for your email of 21 March 2024 to the Ministry of Business, Innovation and Employment
requesting, under the
Official Information Act 1982 (OIA), information from the Department of Labour’s
'Review of Risk Management and Safety in the Adventure and Outdoor Commercial Sectors in New
Zealand 2009/10’.
You have requested:
“Any key documents such as memos, reports, opinions, minutes of the steering and/or working
group which relate to the three key findings referred to above (Inherent risk, Relying solely on the
legislation poses problems, Land managers responsibility).
“…a copy of the guidance for landowners which was issued in response to the final report and any
key documents (briefs, memos, opinions, etc.) which were created in preparing the guidance.”
I am refusing your request under section 18(f) of the OIA as it would require substantial collation. The
Ministry has given you a reasonable opportunity to narrow or clarify your request. No correspondence or
communication has been received from you regarding our requests to discuss narrowing or clarifying your
information request. The information requested is held on a large number of individual files. To provide
you with copies of the information would require staff to manually review each file. Providing this
information would remove Ministry staff from their core duties and therefore the greater public interest
in the effective and efficient administration of the public service would not be served. I have considered
whether the Ministry would be able to respond to your request given extra time or the ability to charge
for the information requested. I have concluded that, in both cases, the Ministry’s ability to undertake its
work would still be prejudiced.
You have the right to seek an investigation and review by the Ombudsman of this decision. Information
