Request for information
Thank you for your Official Information Act 1982 (OIA) request of 9 April 2024. You asked
for information regarding Stop Boxes in the Wellington Region. We apologise for our
delay in responding to you.
My response to each part of your request can be found below.
1.
What activities have the Police undertaken to enforce the appropriate use of
advanced stop boxes in the Wel ington Region. This includes activities undertaken
jointly with the regional council and local territorial authorities or other agencies, and
individual enforcement activities. I would appreciate any statistics you capture about
these activities, such as warnings for other vehicles using the advanced stop boxes.
We note that this information was requested in 2017 and NZ Police transferred this
request to NZTA Waka Kotahi to respond to you. For you reference please refer to the
following link
https://fyi.org.nz/request/6926/response/23283/attach/7/OIA%203414%20Response.pdf
2.
What enforcement or communication activities are planned, or currently in
planning?
Road Policing have advised that “It’s not enforceable, as there is no infringement notice
or bylaws. We are working with Council, but it is difficult without a notice to issue.”
We were also advised by our Data and Information department that:
“If a driver’s actions around an advanced stop box put another road user, for example a
cyclist at risk, then this would be considered an offence (for example, careless driving) –
same as any such driving action, whether on stop box or not. There is currently no way
for Police to identify all driving offences that occurred in advanced stop boxes, and
therefore that information is not held.”
This part of your request is refused pursuant to:
section 18(e) of the OIA, as the document alleged to contain the information requested
does not exist.
Please note that as part of its commitment to openness and transparency, Police
proactively releases some information and documents that may be of interest to the
public. An anonymised version of this response may be publicly released on the New
Zealand Police website.
You have the right to seek an investigation and review by the Ombudsman of this
decision. Information about how to make a complaint is available at
www.ombudsman.parliament.nz or freephone 0800 802 602.
