I am following up on our conversations from last week about the recent media enquiry we have received from Dylan
Cleaver. We are unable to share the full response due the personal nature of some of the information included but,
below is the para we have provided in response to the question about prevention. In addition, our full response
does not suggest that ACC accepts a causal link between concussion and CTE, but rather aims to outline the
complexities and the current state of the evidence.

Concussion prevention
ACC continues with the work delivered through sports injury prevention partnerships including:
A focus on Fair play (the rules are there to protect the players),
Skill and tech (good technique can help players avoid getting into an ‘at risk’ position),
Physical condition (ensuring players are prepared for the physical demands of the sport),
Supporting sports codes to develop and implement concussion policies based on the ACC Sports concussion
guidelines,
Community wide education on how to recognise a concussion and what to do next.
The release of the new international consensus statement on sports related concussion is expected by May 2023, we
will consider what this means in a New Zealand context and update our guidelines.
We continue to work with all of our sports partners to understand where changes to the rules might be needed to
improve player safety.
We know that good early management of concussion improves patient outcomes. ACC has developed and
implemented an ongoing programme of work to improve the management of concussion in primary care, this
includes upskilling of GP’s, option of an extended appointment time to allow for a more comprehensive assessment,
use of a standard assessment tool to support clinical decision making and increased consistency of care.

Below are the key questions included in the media enquiry from Dylan Cleaver. I have removed the personal info.
The person featured in the story has been recognised as having probable chronic traumatic encephalopathy, more
commonly referred to as CTE (a diagnosis that can only be confirmed post‐mortem) as a result of injuries suffered
while playing rugby.
I would like to speak to an ACC spokesperson to determine:
1. Whether this was the first such recognition in terms of compensation in NZ;
2. Whether ACC has subsequently formulated any policy around CTE;
3. Whether there are any plans to roll‐out prevention information;
4. How many CTE claimants there are.
I would also ask the ACC to respond to criticism in the story that the ACC's response to CTE claims has been too
heavily dependent on the claimant providing proof rather than probability of the disease.
