Thank you for your email of 6 May 2023 to the Ministry of Business, Innovation and Employment (MBIE) 
requesting, under the Official Information Act 1982 (the Act), the following information: 
“Since the implementation of the Prostitution Reform Act 2003, how many resident visa holders 
have been deported (or become liable for deportation) because they operate, manage, own, be a 
director of or invest in a commercial sex business. 
Please provide a breakdown for: 
(1) each year since the Prostitution Reform Act implemented.
(2) In each year, please also show the breakdown of the type of resident visas, such as SMC,
partner resident visa etc.
(3) how many of them were liable for deportation and how many of them were actually
deported.”
Our response 
Your request is being refused in full in reliance on section 18(e) of the Official Information Act 1982 as the 
information does not exist, or despite reasonable efforts cannot be located. In accordance with section 
18B of the Act we have considered whether consultation with you would al ow the request to be 
responded to however it is our opinion that it would not. 
The Ministry can advise that the information you have requested is not recorded in MBIE’s case 
management systems to that level of detail. 
You have the right to seek an investigation and review by the Ombudsman of this decision. Information
